As per Provincial Notice 9051 published on 1 April 2025, by virtue of the powers vested in Heritage Western Cape (HWC), as the Provincial Heritage Resources Authority for the province of the Western Cape, and acting in terms of Regulation 7(2) of the Regulations to the NHRA published on 29 August 2003 in Provincial Notice 298 of 2003; the inventory of heritage resources compiled by the City of Cape Town and approved by the Council of Heritage Western Cape is accepted to be an adequate survey of the conservation worthiness of all buildings and/or components of the landscape in the Municipal area of the City of Cape Town; See copy of gazette notice

In terms of Regulation 7(3) of the said Regulations to the NHRA all structures more than 60 years old identified in the City of Cape Town survey as not having significance (i.e. not conservation worthy) are hereby exempted from the need to obtain a permit as required in terms of Section 34 of the NHRA read with Regulation 7(1) of said regulations.

Heritage Western Cape will not be issuing individual letters of exemption.

Applicants are required to consult the City of Cape Town to confirm the grading of their property.
